These Terms of Use govern your use of DamianMooreJr.com and thedamianmoorejr.com (the "Site"), the official website of Damian Moore Jr. ("Damian"), operated on his behalf by Simply Success Sports, LLC, a division of Simply Success Group, LLC ("Simply Success Sports," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Purpose of the Site

The Site shares information about Damian and invites businesses, organizations, and media to inquire about partnerships, appearances, speaking, camps, and other opportunities. Simply Success Sports acts as Damian's representative for these opportunities.

Name, image, and likeness

Damian's name, image, likeness, voice, signature, nickname, and the phrases and marks associated with his personal brand, including "Earned, Not Given," belong to Damian. Nothing on the Site grants you any right to use them. Any commercial use requires a signed written agreement with Damian through Simply Success Sports.

Site content and photos

All text, photographs, graphics, video, and design on the Site are owned by or licensed to Damian or Simply Success Sports and are protected by copyright and other laws. You may view the Site for your own personal or business evaluation. You may not copy, download, edit, republish, sell, or use any content, especially photographs of Damian, in advertising, merchandise, social media, or promotions without written permission.

No endorsement or affiliation

Unless a signed agreement states otherwise, nothing on the Site means Damian endorses, sponsors, or is affiliated with any product, company, or organization. The Site is Damian's personal website. It is not affiliated with, sponsored by, or endorsed by any college or university, athletic conference, the NCAA, or any professional league.

Inquiries are not agreements

Submitting an inquiry form or email does not create a contract, guarantee a response, or commit Damian or Simply Success Sports to any opportunity, price, or date. An opportunity becomes binding only through a written agreement signed by Damian and the other party.

NIL compliance

All opportunities are subject to applicable state and federal law, institutional and conference rules, and NIL disclosure and reporting requirements, including review through the NIL Go clearinghouse where required. Compensation will not be offered or accepted in exchange for athletic performance, playing time, enrollment, or as an inducement to attend or remain at any institution. We may decline any opportunity for any reason, including compliance, values, or scheduling.

Acceptable use

You agree not to:

  • Submit false, misleading, harassing, or unlawful information.
  • Impersonate any person or business.
  • Attempt to contact Damian directly to arrange commercial opportunities outside his representation.
  • Interfere with the Site's operation or security, or use automated tools to scrape it.
  • Use the Site in any way that violates law or these Terms.

The Site may link to websites and social media platforms we do not control. We are not responsible for their content, policies, or practices.

Disclaimer

The Site and its content are provided "as is" and "as available." Statistics and biographical details are provided for general information and may change. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Damian, Simply Success Sports, Simply Success Group, LLC, and their owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100).

Indemnification

You agree to defend and hold harmless Damian, Simply Success Sports, and Simply Success Group, LLC from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, or your unauthorized use of Damian's name, image, or likeness.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute about the Site will be brought in the state or federal courts located in Orange County, Florida. This section applies only to use of the Site; any partnership or appearance agreement is governed by its own terms.

Changes to these Terms

We may update these Terms at any time by posting a new version on this page. Continued use of the Site after a change means you accept the updated Terms.
